Outside the residential districts, the Commercial and Industrial Zone Districts run on a separate, more permissive bulk standard, Sec. 23-3-250(D) and Sec. 23-3-340(D), which each cap lot coverage at 85 percent instead of the 50-70% residential range.
Violations & Fines
Building or maintaining a structure that exceeds the Table 23.2 lot coverage cap without an approved Special Review Permit is an unlawful use of land under Sec. 23-10-20, a misdemeanor carrying up to a $100 fine or 10 days in jail per day of violation. Sec. 23-10-40 also allows the County Attorney to pursue a civil penalty of $25 to $1,000, plus a continuing penalty of up to $100 for each day the excess coverage remains, which can be recorded as a lien against the property.
