Sec. 72-241, the classifications section of the Land Development Code, sets a 'minimum yard size' entry inside the dimensional-requirements table for each of the county's zoning districts. In the A-1 Prime Agriculture classification the front yard must be at least 100 feet, the rear yard 50 feet, the side yard 50 feet, and the waterfront yard 50 feet, on a minimum ten-acre, 150-foot-wide lot. The adjoining A-2 Rural Agriculture classification, meant for smaller rural-estate parcels, cuts the front yard to 50 feet and the side yard to 25 feet while keeping the same 50-foot rear and waterfront yards, on a minimum five-acre lot.
Waterfront yards for both classifications are governed together with the general waterfront-yard rule in Sec. 72-294, and accessory structures can qualify for reduced setbacks under the exceptions listed in Sec. 72-277. Where an existing lot cannot meet the applicable yard, Sec. 72-379 allows the board of adjustment to grant a variance, but only for height, area, yard size, parking and residential lot coverage -- not to authorize a use the zoning classification doesn't otherwise permit. Every other unincorporated classification, from rural residential through the R-series urban districts and the commercial and industrial classes, carries its own yard figures in the same Sec. 72-241 table, so the controlling number always depends on which classification applies to the parcel in question.
Violations & Fines
Building within the required front, side or rear yard without an approved variance is a Sec. 72-241 zoning violation, caught at building-permit review or by code enforcement inspection. Sec. 72-379 is the only relief valve -- a variance from the board of adjustment -- and it cannot be used to authorize a use the parcel's classification doesn't already allow.
