030(D) of the Rialto Municipal Code sets the height standard for the R-1 single-family zone: buildings are limited to two and one-half stories and may not exceed 35 feet, measured under the code's definition of building height as the vertical distance from the average finished ground level of the site to the highest point of the structure, excluding chimneys and ventilators. Multi-family zones are allowed to go higher: the R-3 zone permits up to three stories and 35 feet, requiring any floor above the second to step back 35 feet from the ultimate street right-of-way, while the R-4 high-density zone allows six stories or 75 feet.

56, the citywide exceptions chapter, allows specific rooftop features to exceed the zone height limit even though the base structure cannot: penthouses or roof structures housing elevators, stairways, tanks, or ventilating fans, along with fire or parapet walls, skylights, towers, steeples, flagpoles, chimneys, smokestacks, wireless and television masts, water tanks, and silos, may be built above the maximum height where they can be safely erected given surrounding conditions. That exception is expressly limited: no structure or penthouse under it may be used to add usable floor space.

A homeowner who needs a taller roofline than the base standard allows must therefore seek a variance from the planning commission rather than rely on the rooftop-equipment exception.
