Summary

Pitt County requires a $500 sexually oriented business license before any adult arcade, bookstore, cabaret, motel, theater, escort agency or similar establishment may open, and bars them within 1,320 feet of another such business or of homes, schools, churches, day cares or parks.

These county ordinances apply to unincorporated areas of Pitt County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

A. Overconcentration. No more than one (1) sexually oriented business shall be located in any one thousand three hundred and twenty (1320) foot radius (determined by a straight line measured from building to building and not by street distance)... B. Residential Proximity. No sexually oriented business shall be located within a one thousand three hundred twenty (1320) foot radius... of any place of worship, a residential dwelling, a school (public or private), specialty school, day-care facility, or a lot or parcel of land on which a public playground, public swimming pool, or public park is located.

Full Breakdown

Ordinance No. 2, the Ordinance Regulating Adult Establishments Sexually Oriented Businesses, makes it unlawful under Section 4 to operate without a license approved by the Code Enforcement Officer; applicants must submit a scaled sketch of the premises, total floor space, and the property tax parcel number, and must obtain a special use permit when zoning requires one. S. Chapter 14 Articles 7A, 26, 26A, 27, 37 or 39. The Pitt County Sheriff's Office runs the criminal history check that feeds this decision. Section 7 sets a nonrefundable $500 license fee payable to Pitt County.

Section 8 imposes two spacing rules measured building to building, not by street distance: no more than one sexually oriented business within any 1,320-foot radius of another (overconcentration), and none within 1,320 feet of a place of worship, residential dwelling, public or private school, specialty school, day-care facility, public playground, swimming pool, or park. Businesses lawfully operating when the ordinance took effect but now nonconforming get one year to come into compliance under Section 9. The ordinance applies throughout unincorporated Pitt County, in municipalities the Sheriff patrols, and in any municipality that asks by resolution for county enforcement.

Violations & Fines

Operating without a license, or in violation of the spacing rules, is a misdemeanor punishable under G.S. § 14-4(a) per Section 15, and the county may also seek an injunction or order of abatement under G.S. §§ 153A-123(d)-(e) or G.S. § 160D-404. The Code Enforcement Officer may suspend a license up to 30 days for noncompliance, illegal gambling on premises, or refusing an inspection, and must revoke a license for false application information, allowing controlled substances, prostitution, or nudity within five feet of a patron; a revoked license bars reapplication for one year. Each day of continuing violation is a separate offense.

Frequently Asked Questions

How far must a Pitt County adult business be from a school or church?
At least 1,320 feet, measured in a straight line from building to building rather than by street distance, from any place of worship, residential dwelling, public or private school, specialty school, day-care facility, public playground, swimming pool, or park, per Section 8 of Ordinance No. 2.
Can two sexually oriented businesses operate near each other in Pitt County?
No. Section 8's overconcentration rule bars more than one sexually oriented business within any 1,320-foot radius of another, measured building to building, to prevent clustering that the county finds contributes to neighborhood blight.
What disqualifies an applicant from a Pitt County sexually oriented business license?
Being under 18, owing delinquent county taxes or fees tied to the business, failing to provide required information, or a conviction under G.S. Chapter 14 Articles 7A, 26, 26A, 27, 37 or 39 within the lookback window set by Section 5, verified through a Sheriff's Office criminal history check.
