40. 030 imposes two hard distance rules the Council cannot waive: no adult entertainment lot line may sit within 1,000 feet of any residential, multi-family, two-family (duplex) or apartment district, or of a nursery, elementary, intermediate or high school, public park, church, synagogue or daycare; and no adult entertainment lot may sit within 1,000 feet of another adult entertainment lot. Measurement runs in a straight line between lot lines, ignoring intervening buildings. 040 requires the applicant to disclose owner and operator names and addresses, a description of services, the planned opening date, corporate/partnership documents identifying shareholders, and proof of a right to occupy the premises, plus a filing fee set in the annual budget.

050 lets the Council deny a permit if an owner is under 21, owes the County unpaid taxes or fines tied to an adult business, gave false information, or the premises has not cleared state health, fire or zoning inspection. A granted permit must be posted at the entrance and expires one year after the ordinance grants it, requiring reapplication to continue operating.
