Summary

Washoe County bans adult bookstores, cabarets, arcades, and similar businesses within 1,000 feet of schools, day-care centers, parks, churches, gaming establishments, or each other, and confines them to industrial zoning or gaming-licensed tourist commercial parcels. A waiver from the Board of County Commissioners is the only way around the distance rule.

City-specific rules exist: Reno has its own adult entertainment rules that differ from Washoe County's county-level regulations. If you live in Reno, check the city-specific page instead.

Except as provided in subsection 4, it is unlawful to commence operating an adult bookstore, adult drive-in theater, adult hotel or motel, adult interactive cabaret, adult motion picture arcade, adult motion picture theater, or model studio if, at the time of application, there is within 1,000 feet or less any public or licensed private kindergarten, elementary school, junior high school, middle school, high school, college, university; licensed day-care center; public park or recreational area; church or religious educational center; civic building in which the public frequents; or other adult characterized business. ... an adult characterized business enumerated in subsection 1 may only be located in the industrial regulatory zoning category or in an establishment holding an unlimited gaming license located in a tourist commercial regulatory zoning category. Additionally, no adult characterized business enumerated in subsection 1 may be located within 1,000 feet of a residentially zoned area, or of an establishment holding an unlimited gaming license.

Full Breakdown

053 makes it unlawful to commence operating an adult bookstore, adult drive-in theater, adult hotel or motel, adult interactive cabaret, adult motion picture arcade, adult motion picture theater, or model studio within 1,000 feet of any public or licensed private school from kindergarten through college, a licensed day-care center, a public park or recreational area, a church or religious educational center, a civic building the public frequents, or another adult characterized business. The section further confines these businesses to the industrial regulatory zoning category, or to an establishment holding an unlimited gaming license in a tourist commercial zone, and separately bars them from locating within 1,000 feet of any residentially zoned area or of an unlimited-gaming establishment.

Distances are measured as a straight line from the affected use's property line to the nearest edge of the building housing the adult business, without regard to intervening structures. A business that cannot meet the distance rule can apply to the Board of County Commissioners for a waiver; the county clerk must set a public hearing within 45 days of a complete application, and the board can grant it only after finding the use will not cluster with other adult businesses, increase crime, sit in an area minors frequent, contribute to blight, or otherwise harm public health, safety, or welfare.

A denied waiver comes with a written statement of reasons within ten days. 0531 layers on operating standards for any qualifying structure, including opaque window coverings, a public-entrance barrier blocking sightlines into the business, unlocked public-area doors during business hours, and a minimum of one foot-candle of exterior lighting on the sidewalk and parking area.

Violations & Fines

Commencing or operating an adult characterized business inside the 1,000-foot buffer, outside the required industrial or gaming-zoned tourist commercial area, or without the structural safeguards required by WCC 25.0531 is a licensing violation the License Division and sheriff enforce. Workers also need a five-year sheriff-issued work permit under WCC 25.0533, which can be denied for prostitution, lewd conduct, solicitation, sexual assault, indecent exposure, or drug trafficking convictions within the past ten years.

Frequently Asked Questions

How far must an adult business be from a school or park in Washoe County?
At least 1,000 feet, measured in a straight line from the property line of the school, day care, park, church, civic building, or gaming establishment to the nearest edge of the building housing the adult business, per WCC 25.053. The same 1,000-foot buffer applies between two adult characterized businesses.
Can an adult business get an exception to the distance rule?
Yes, but only through a waiver from the Board of County Commissioners under WCC 25.053(4). The applicant files with the county clerk, a public hearing is set within 45 days, and the board must find the waiver won't cluster adult businesses, raise crime, or harm the surrounding area before granting it.
Do employees of adult businesses need their own permit?
Yes. WCC 25.0533 requires anyone working at an adult characterized business who has contact with the public to hold a work permit issued by the sheriff, valid for five years, which can be denied for disqualifying convictions like prostitution or indecent exposure within the past ten years.
