Growth and Resource Management reviews these distances at site plan and zoning compliance stages, and a use that fails any one of the three tests cannot be approved regardless of underlying I-1 zoning.
This provision applies only in the unincorporated county; Daytona Beach, Deltona, Ormond Beach, Port Orange, New Smyrna Beach, DeLand, Edgewater, DeBary and Orange City each administer their own separate adult-use zoning standards.
Violations & Fines
A proposed adult bookstore or theatre that fails any of the three distance tests, or that is proposed outside the I-1 classification, is denied at the zoning or site plan review stage; there is no administrative waiver built into section 72-293(1). Operating without the required zoning compliance exposes the property owner to code enforcement action, including a special magistrate hearing and fines under the county's code enforcement provisions in chapter 2, article VII.
