Notwithstanding any other provision of this article or any provision of article VI of this chapter, no person shall cause or permit the establishment or operation of any adult entertainment establishment: (1)Within 1,500 feet from any other adult entertainment establishment; (2)Within 1,500 feet from any preexisting religious institution, school or day care center; (3)Within 1,500 feet from any area zoned for residential use within the county;

Under the county's Adult Entertainment Code (ch. 62, art. XV), no adult bookstore, adult motion picture theater, leisure spa, or adult dancing establishment may locate within 1,500 feet of another adult entertainment establishment, a preexisting school, religious institution, or day care center, or land zoned for residential use. Businesses are confined to BU-1, BU-2, IU, IU-1, TU-1, and PIP zoning districts, and a separate corridor near Kennedy Space Center along U.S. 1 and SR 405 is entirely excluded. Establishments operating before the ordinance may continue as nonconforming uses but cannot expand and lose that status after 180 consecutive days closed. This applies only in unincorporated Brevard; Titusville, Cocoa, and other cities license adult businesses under their own codes.
Violations & Fines
Violating the Adult Entertainment Code is punishable under Florida general law, F.S. § 125.69, and the county may also suspend or revoke the business's adult entertainment license or sue to enjoin the operation.
