Summary

Volusia County confines adult bookstores and adult theatres to the I-1 industrial zoning classification and imposes strict spacing rules in the unincorporated county. A 1,000-foot gap is required between any two such businesses, and 400 feet must separate them from churches, schools, parks and residential-type zoning districts.

City-specific rules exist: Deltona, Daytona Beach, and Port Orange have their own adult entertainment rules that differ from Volusia County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

Full Breakdown

Under the county's Land Development Code, adult bookstores and adult theatres are permitted principal uses only within the I-1 zoning classification. Section 72-293(1)a sets three location tests that stack on top of that zoning limit: no adult bookstore or theatre may sit within 400 feet of land zoned C, P, FR, RC, A-1 through A-3, RA, RR, R-1 through R-9, MH-1 through MH-8, OUR, AP, SWC, SWR or PUD (unless the use is itself part of that PUD); none may locate within 1,000 feet of any other adult bookstore or theatre; and none may sit within 400 feet of a church, public school, public park or recreational facility, or a public school bus stop.

All three distances are measured property line to property line, without regard to the actual route of travel, so the county does not credit a longer walking or driving path between two sites. Because I-1 industrial land bordered by a qualifying buffer is comparatively scarce across unincorporated Volusia, the combined effect of the zoning confinement and the three spacing tests functions as a near-exclusionary siting scheme rather than a simple use permit. Growth and Resource Management reviews these distances at site plan and zoning compliance stages, and a use that fails any one of the three tests cannot be approved regardless of underlying I-1 zoning.

This provision applies only in the unincorporated county; Daytona Beach, Deltona, Ormond Beach, Port Orange, New Smyrna Beach, DeLand, Edgewater, DeBary and Orange City each administer their own separate adult-use zoning standards.

Violations & Fines

A proposed adult bookstore or theatre that fails any of the three distance tests, or that is proposed outside the I-1 classification, is denied at the zoning or site plan review stage; there is no administrative waiver built into section 72-293(1). Operating without the required zoning compliance exposes the property owner to code enforcement action, including a special magistrate hearing and fines under the county's code enforcement provisions in chapter 2, article VII.

Frequently Asked Questions

Can an adult bookstore locate anywhere in unincorporated Volusia County?
No. Section 72-293(1) confines adult bookstores and adult theatres to land zoned I-1 industrial, and even there the site must clear 1,000 feet from any other adult bookstore or theatre and 400 feet from churches, schools, parks, recreational facilities, school bus stops, and a long list of residential and other buffer zoning classifications.
How is the required distance measured?
Property line to property line. The code specifically disregards the actual route of travel, so a site cannot argue that a river, highway or building layout makes the practical distance greater than the straight-line measurement used for compliance.
Does a PUD exception exist?
Yes, narrowly. An adult bookstore or theatre within 400 feet of a PUD-zoned parcel is exempt from that particular restriction only if the adult use itself is part of that same PUD; it does not exempt the use from the 1,000-foot or 400-foot church/school/park distances.
