Current operators, owners and employees had to be fingerprinted by July 1, 2026; anyone becoming a new operator, taking an ownership stake, or starting employment afterward must complete the check first. CBI runs the state check and forwards prints to the FBI for a national check, then reports results to the Sheriff's Office, which uses them to decide whether an individual is disqualified. The individual being checked pays all associated costs, and a third-party vendor using livescan equipment cannot retain the fingerprint data for more than 30 days.

An Employee is defined broadly to include independent contractors doing routine facility work, but excludes massage therapists themselves and janitorial or maintenance contractors with no client contact. An Owner is disqualified outright if they skip the required check at least 30 days before taking an ownership interest, or if they were convicted of, or pleaded nolo contendere to, solicitation of a prostitute, human trafficking, or money laundering, or must register as a sex offender. An Operator or Owner is separately barred from employing anyone who has not completed the required check, though the policy allows retaining or hiring a person with a disqualifying record if the Operator or Owner determines the person poses no threat to customers or staff.
