Summary

Every pawnbroker doing business in unincorporated Sedgwick County must keep a written register of every item purchased or received, entered in ink within one hour of the transaction, and hand two legible daily copies to the sheriff's department by noon covering the prior day's activity. Skipping this defaults to a Class F violation under Sec. 8-5(b).

City-specific rules exist: Wichita has its own pawnbrokers rules that differ from Sedgwick County's county-level regulations. If you live in Wichita, check the city-specific page instead.

Every pawnbroker shall maintain at his place of business a register in which shall be entered in writing a detailed description of all property purchased or received in the conduct of business, including size, color, any trade or brand name, the model number and any serial number or identification number in or upon such property, the time of the purchase or receipt, and the correct legal name, as shown on at least two (2) items of identification, and the place of residence, including street and number, of the person selling or leaving the property, together with the drivers license number of such person if the license is available and, if not, other similar identification. The register shall also set forth the amount paid for or loaned upon the property. All such entries shall be made in ink and written within one (1) hour after purchase or receipt. No entry shall be erased, obliterated or defaced.

Full Breakdown

A. 16-706 et seq. Sec. 17-72 requires every pawnbroker to maintain, at the place of business, a register describing each item purchased or received: size, color, any trade or brand name, model and serial numbers, the time of purchase or receipt, the seller's correct legal name verified against at least two forms of identification, the seller's residence address, and their driver's license number if available. The register must also record the amount paid or loaned, entries must be made in ink within one hour of the transaction, and no entry may be erased, obliterated or defaced.

Sec. 17-73 then requires the pawnbroker to prepare two legible, correct copies of the prior day's register entries every day before 12:00 noon, available to any sheriff's deputy, including a physical description of the person who pawned or sold the item (hair color, eye color, height, weight, date of birth, race and sex), on individual forms no larger than four by six inches. A. 16-715. Sec. 17-71 makes Article III enforceable under Chapter 8, and because the article sets no violation classification of its own, a violation defaults to a Class F offense under Sec. 8-5(b), the county's baseline classification for code violations that aren't otherwise assigned a class.

Violations & Fines

Failing to keep the register in ink, missing the one-hour entry deadline, erasing an entry, or missing the noon deadline to report to the sheriff's department is prosecuted in county court under Chapter 8. Because Article III sets no classification of its own, it defaults to a Class F offense under Sec. 8-5(b): $50 for a first offense within a rolling 12-month period, $100 for a second, and $150 for a third. The sheriff's department can request the register and daily reports at any time to check compliance.

Frequently Asked Questions

Does Sedgwick County issue its own pawnbroker license?
No. Pawnbrokers and precious metal dealers are licensed under Kansas law, K.S.A. 16-706 et seq. What County Code Chapter 17, Article III adds is the local recordkeeping and daily reporting duties in Sec. 17-72 and 17-73, enforced by the sheriff's department on top of the state license.
What has to go in the pawnbroker's register?
Sec. 17-72 requires a written register with a detailed description of every item purchased or received: size, color, brand, model and serial numbers, the time of the transaction, the seller's legal name verified against two forms of ID, their address, and driver's license number. Entries must be in ink within one hour and can never be erased.
How often must a pawnbroker report to the sheriff?
Every day before 12:00 noon, per Sec. 17-73. The pawnbroker must prepare two legible copies of the prior day's register entries, including a physical description of the person who pawned or sold the item, on forms no larger than four by six inches, and keep them available until the sheriff's department claims them.
What's the penalty for not keeping the register?
Article III doesn't set its own fine schedule, so violations default to a Class F offense under Sec. 8-5(b): $50 for a first offense within 12 months, rising to $100 for a second and $150 for a third, payable through Sedgwick County court under Chapter 8.
