Businesses in Hillsborough County that sell vapor-generating devices or vapor products must check government-issued ID and cannot sell to anyone under 21, with mandatory point-of-sale age signage.

These county ordinances apply to unincorporated areas of Hillsborough County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

It shall be a violation of this article for any business or its employee, agent, or representative (seller) operating within Hillsborough County to sell, give, barter, furnish, or deliver any vapor-generating electronic device, or any vapor product used in such device to a person under 21 years of age. Seller must require the purchaser to produce a government issued identification card (driver's license, passport, military, student, etc.) which verifies the purchaser's age.

(b) Any business selling, or offering for sale, any vapor-generating electronic device, or any vapor product used in such device shall post a clear and conspicuous sign in each place of business where such products are sold which substantially states the following:

THE SALE OF VAPOR-GENERATING ELECTRONIC DEVICES OR THE VAPING PRODUCTS USED IN SUCH DEVICES TO PERSONS UNDER THE AGE OF 21 IS A VIOLATION OF HILLSBOROUGH COUNTY ORDINANCE. PROOF OF AGE IS REQUIRED FOR PURCHASE.

(c) Any business selling, or offering for sale, any vapor-generating electronic device, or any vapor product used in such device shall provide at the checkout counter in a location clearly visible to the business' employee, agent, or representative instructional material in a calendar format or similar format to assist in determining whether a person is of legal age to purchase such products or devices. Full Breakdown

Sec. 10-729 of the Vaping Ordinance bars any business, employee, or agent from selling, giving, or delivering a vapor-generating device or vapor product to someone under 21, and requires sellers to check a government-issued ID. Retailers must post a conspicuous sign warning that sales to under-21 buyers violate county ordinance, and must display checkout-counter material with a birth-date cutoff to help staff judge legal age. The article does not separately license or zone vape retailers; it regulates the sales transaction itself.

Violations & Fines

Selling to a minor is prosecuted as a second-degree misdemeanor against the business and the employee; failing to post the required signs or point-of-sale material is a non-criminal code violation against the business.
