Summary

Polk County bars retailers from selling tobacco products through open, self-service displays or vending machines unless the products sit inside a dedicated tobacco specialty shop or the retailer keeps minors off the premises entirely. Every sale must be vendor-assisted, and the rule reaches every store in both the incorporated and unincorporated county.

These county ordinances apply to unincorporated areas of Polk County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

No person, business, tobacco retailer or other establishment subject to this section shall sell, permit to be sold, offer for sale or display for sale any tobacco products by means of self-service merchandising or any other means than vendor assisted sales, unless the tobacco products are located inside a tobacco specialty store, or access to the premises by persons under the age of eighteen (18) is prohibited by the person, business, tobacco retailer or other establishment or is prohibited by law.(c)Applicability. This section shall apply to the unincorporated and incorporated areas of Polk County in accordance with Article 1, Section 1.8 of the Polk County Home Rule Charter.(d)Penalty. Violation of this section shall be punished by a fine not to exceed five hundred dollars ($500.00) or imprisonment for sixty (60) days or by both such fine and imprisonment. (Ord. No. 00-75, §§ 1—4, 11-14-00)

Full Breakdown

5-5 defines self-service merchandising as any open display of tobacco products the public can reach without a vendor, store owner, or employee stepping in, and specifically includes vending machines. Under subsection (b), no person, business, tobacco retailer, or other establishment may sell, offer for sale, or display for sale tobacco products by self-service merchandising or any method other than vendor-assisted sales. Only two situations avoid the vendor-assisted requirement: the tobacco products are located inside a "tobacco specialty shop," defined as a business where fifty percent or more of display space or gross revenue comes from pipe tobacco or cigars, or the retailer bars anyone under eighteen from the premises entirely, whether by its own policy or by law.

The definitions section also covers "tobacco products," meaning loose tobacco leaves and products made from tobacco leaves, and cigarette wrappers usable for smoking, sniffing, or chewing. 8 of the Polk County Home Rule Charter, so it reaches every municipality in the county, not just the unincorporated area. The ordinance was adopted in 2000 under Ordinance No. 00-75.

Violations & Fines

Violating the self-service merchandising ban is punishable under subsection (d) by a fine of up to $500, imprisonment for up to sixty days in the county jail, or both. Because the section applies countywide under the Home Rule Charter, a retailer in an incorporated city as well as an unincorporated store can be cited for stocking open tobacco displays without a vendor present.

Frequently Asked Questions

Can a Polk County gas station display cigarettes on an open rack customers can grab themselves?
No. Section 10.5-5(b) prohibits selling or displaying tobacco products through self-service merchandising, meaning any open display the public can access without a vendor's help, unless the store is a qualifying tobacco specialty shop or bars anyone under eighteen from entering. A standard convenience store must keep tobacco behind the counter or in a case a clerk unlocks.
Does the tobacco self-service ban apply inside Lakeland or Bartow city limits?
Yes. Section 10.5-5(c) states the section applies to both the unincorporated and incorporated areas of Polk County under Article 1, Section 1.8 of the county's Home Rule Charter, so the self-service restriction reaches retailers inside cities like Lakeland and Bartow as well as unincorporated stores, unless a municipality has since adopted its own conflicting ordinance.
What counts as a 'tobacco specialty shop' exempt from the vendor-assisted rule?
Section 10.5-5(a) defines a tobacco specialty shop as a business where fifty percent or more of its display space, such as wall space, tables or racks, or fifty percent or more of its gross revenue, comes from selling pipe tobacco or cigars. A convenience store that sells cigarettes alongside groceries and gas does not qualify for this exception.
