Summary

Polk County caps what tow truck operators can charge for nonconsensual tows made from private property or requested by law enforcement, setting maximum rates by county resolution rather than letting operators name their own price. Operators who register with the Sheriff's Office must document every charge, and repeat overcharging gets a company pulled from the Sheriff's call-out rotation.

City-specific rules exist: Winter Haven, and Lakeland have their own towing companies rules that differ from Polk County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

Frequently Asked Questions

Can a tow company in Polk County charge whatever it wants for a nonconsensual tow?
No. Section 10.3-61 states the county's intent to regulate the maximum price for nonconsensual towing, and section 10.3-63 limits billing to specific named charges such as the towing service fee, extra-time charge and storage charge. The dollar ceiling for each charge is fixed by a resolution of the Board of County Commissioners, and billing above that ceiling or inventing an unlisted fee is a violation.
How long do I have to get my car back before storage fees apply?
Section 10.3-63 lets an owner, lessee or agent recover a vehicle without paying any storage charge if they show up at the towing company within six hours of the vehicle being placed in the storage area and pay all other lawful charges. After six hours, the per-day storage charge set by the county's resolution applies.
What happens to a tow company that overcharges more than once?
Under section 10.3-65, a company with two overcharging violations in any twelve-month period is removed from the Polk County Sheriff's Office call-out list for sixty days, and three or more violations within eighteen months results in a full year's removal. The company also owes the vehicle owner the amount overcharged, any vehicle damage, and the owner's court costs and attorney's fees.
