Operating a marijuana dispensary without the required Type III conditional use permit, or outside its approved floor area, hours or odor mitigation plan, is a zoning violation under Pima County Code § 18.95.030, enforced by the chief zoning inspector and decided by a county hearing officer. Section 18.95.040 sets civil penalties up to $750 per day for an individual and $10,000 per day for a corporation, appealable to the Board of Supervisors and then Pima County Superior Court under A.R.S. § 12-901.
