Boone County, KY Cannabis Regulations: Dispensary Zoning (2026)

Fiscal Court adopted Ordinance 2024-18 on June 18, 2024, creating Chapter 119, Cannabis Business. 010 wholesale, so the same terms used in Kentucky's medical cannabis program, including cultivator, processor, producer, dispensary and safety compliance facility, govern here. 02 then states in a single sentence that all cannabis businesses are prohibited from operating within the Boone County limits. There is no siting overlay, distance buffer or licensing process because the county closed the door entirely instead of choosing where such a business could locate. The ban reaches only the unincorporated county; Boone County's ordinances do not extend inside Florence, Union or Walton, each of which enforces its own municipal code and could take a different local position.

Land-use planning in the unincorporated county is otherwise coordinated regionally through the Northern Kentucky Area Planning Commission, but that coordination has no bearing here since Fiscal Court chose an outright prohibition rather than a zoning-based siting rule. Kentucky's medical cannabis program is licensed and regulated at the state level under KRS Chapter 218B, and Boone County used its local authority to shut every category of state-licensed cannabis business out of the county entirely.
