Summary
Unincorporated Lake County bars every Medical Marijuana Treatment Center Dispensing Facility from opening or operating anywhere within its borders. The countywide ban, adopted under LDR § 3.15.00, covers the storefronts, clinics and offices that Florida's Department of Health licenses to sell marijuana, low-THC cannabis and cannabis derivative products, leaving zero zoning districts where a dispensary can locate.
Medical Marijuana Treatment Center Dispensing Facilities are prohibited from being located in or operated in the unincorporated boundaries of Lake County.

Full Breakdown
" Unlike many Florida counties that confine dispensaries to commercial or industrial districts with buffers from schools and residences, Lake County created no zoning district, conditional use permit, or distance-based exception anywhere in the LDR; the ban is countywide and unconditional for the unincorporated area. " That definition sweeps in retail storefronts as well as any clinic or office set up to hand out cannabis products, regardless of size or location. The ordinance was adopted October 24, 2017, by Ordinance No. 2017-53, § 4, in the same wave of local opt-out ordinances that followed voter approval of Florida's medical marijuana constitutional amendment.
The prohibition is written specifically for the retail dispensing side of the business; it does not appear in this section as reaching cultivation, processing, or other licensed activities, which are separately regulated at the state level. Because the seven incorporated cities in Lake County set their own zoning, a dispensary barred here could still be legal blocks away inside Leesburg, Clermont, Eustis, Mount Dora, Tavares, Groveland or Minneola city limits.
Violations & Fines
Operating or attempting to open a Medical Marijuana Treatment Center Dispensing Facility anywhere in the unincorporated area is a Land Development Code violation with no cure: § 3.15.00 leaves no zoning district, conditional use, or variance path around the ban. Lake County Code Enforcement treats an operating dispensary as any other unpermitted land use, subject to a cease-operation order.
