Recreational cannabis dispensaries are prohibited statewide. Only three TCUP licensees operate in Texas under the Compassionate Use Program with no dispensary located in Collin County. Delta-8 and hemp retailers operate under separate DSHS rules.
Texas classifies marijuana as a Schedule I controlled substance under TX HSC Β§481.032. Recreational sale, possession, and cultivation remain illegal; possession of 2 oz or less is a Class B misdemeanor (TX HSC Β§481.121), up to 180 days jail + $2,000 fine. The Compassionate Use Program (CUP) under TX HSC Ch. 487 licenses only three dispensary organizations statewide (Fluent, Goodblend, Surterra/Parallel) to dispense low-THC cannabis (β€1% by weight) to registered patients with qualifying conditions (epilepsy, MS, PTSD, terminal cancer, autism). No CUP pickup location operates in Collin County; patients order and receive delivery from Austin-area dispensaries. Hemp-derived products (CBD, delta-8 THC) fall under TX Ag Code Ch. 122 and TX HSC Β§443; DSHS licenses retailers ($258 annual fee). SB 3 (2025) would have banned delta-8; Governor Abbott vetoed. Neither Collin County nor its cities (Plano, Frisco, McKinney, Allen) have adopted local hemp dispensary bans.
