Virginia legalized recreational marijuana possession and home cultivation effective July 1, 2021, under VA Code Β§4.1-1101. Adults 21 and older may cultivate up to four (4) cannabis plants per household (NOT per adult) for personal use. Requirements: (1) plants must not be visible from a public right-of-way; (2) each plant must be tagged with the grower's name, driver's license or ID number, and a notation that it is for personal use under VA Β§4.1-1101; (3) plants must be kept out of reach of anyone under 21 β typically a locked greenhouse, basement grow, or secured outdoor area. Virginia's retail cannabis market was authorized in 2021 but retail sales remain delayed due to political disputes β as of 2026, no licensed recreational dispensaries operate in Virginia (medical program continues under Cannabis Control Authority). Loudoun County Board of Supervisors has not passed additional home cultivation restrictions beyond state law. Possession: adults 21+ may possess up to 1 ounce in public. Possession in a public place may remain subject to local enforcement. Growing beyond 4 plants is a misdemeanor (5-49 plants) or felony (50+). Distribution/sales without license: remains a felony. Federal law still classifies cannabis Schedule I β federal property (Dulles Airport, Washington & Old Dominion Trail in places) enforces federal prohibition. HOAs may restrict home cultivation under their covenants. Landlords may prohibit in leases.
