Recreational cannabis is legal to buy and use in Washington, but growing it at home is illegal statewide, including in Benton County. Only qualifying medical patients may cultivate, and then only a limited number of plants under state medical law.
Washington legalized recreational cannabis through Initiative 502 (RCW 69.50), yet it remains one of the few legal states that bans recreational home growing entirely. No adult may grow cannabis for personal recreational use anywhere in Benton County. The narrow exception is medical: a qualifying patient or designated provider entered in the state's medical cannabis authorization database may grow up to six plants, and more with a practitioner's recommendation, under RCW 69.51A. The Liquor and Cannabis Board regulates all legal cannabis. Landlords may bar growing in rentals, and unlicensed cultivation for sale is a serious crime.
Growing cannabis without qualifying medical authorization is unlawful throughout Washington, and cultivating for unlicensed sale is a felony. Exceeding a patient's plant limit or growing recreationally can bring criminal charges.
