Home cannabis cultivation is illegal throughout Bay County. Florida allows medical marijuana only, and even registered patients may not grow their own. Recreational use remains illegal; the 2024 Amendment 3 failed.
Florida permits medical marijuana under Amendment 2 (2016) and Fla. Stat. §381.986, but it authorizes no home cultivation, even for qualified patients. Patients and caregivers obtain product only from a licensed Medical Marijuana Treatment Center; growing marijuana violates §893.13 and is a criminal offense. Recreational cannabis is not legal in Florida: the 2024 adult-use Amendment 3 received about 56 percent, short of the 60 percent needed to pass. No Bay County or city ordinance can override state law, so any home grow in Panama City, Panama City Beach, or Lynn Haven is illegal.
Cultivating marijuana is a criminal offense under Fla. Stat. §893.13, prosecuted by weight and plant count, and can bring felony charges, prison, and fines. A patient's registry status may also be revoked.
