Summary

Butte County's code enforcement program, set out in Chapter 41, polices violations across eighteen separate chapters of county code, from zoning and building to sewage disposal, water wells, mobile home standards, solid waste, noise and stormwater. Section 41-1 names each chapter the program covers, and Section 41-5 sets the fines that follow a conviction under any of them.

These county ordinances apply to unincorporated areas of Butte County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

The following policies and procedures are adopted to implement a program of enforcement of Butte County's zoning, building, sanitation and other ordinances contained in the following chapters of this Code: Chapter 10, Highways and Streets; Chapter 11, Junk Dealers, Pawnbrokers and Secondhand Dealers; Chapter 13, Grading and Mining; Chapter 14, Motor Vehicles and Traffic; Chapter 19, Sewage Disposal; Chapter 23B, Water Wells; Chapter 24, Zoning; Chapter 26, Buildings; Chapter 26A, Underground Utility Districts; Chapter 28A, Mobilehome and Mobilehome Lot Standards; Chapter 28B, State Housing Law Requirements; Chapter 31, Solid Waste Collection, Management and Recycling; Chapter 32, Naming of Streets and Highways; Numbering Properties and Principal Buildings; Chapter 33, Groundwater Conservation; Chapter 37, Underground Hazardous Substance Storage Facilities; Chapter 41A, Noise Control; Chapter 50, Stormwater Ordinance; Chapter 53, Camp Fire Disaster Recovery; Chapter 54, North Complex Fire Recovery; and Chapter 56, Park Fire and Thompson Fire Recovery.

Full Breakdown

Section 41-1 lists the exact chapters Butte County's code enforcement officers are authorized to enforce: Chapter 10 (Highways and Streets), Chapter 11 (Junk Dealers, Pawnbrokers and Secondhand Dealers), Chapter 13 (Grading and Mining), Chapter 14 (Motor Vehicles and Traffic), Chapter 19 (Sewage Disposal), Chapter 23B (Water Wells), Chapter 24 (Zoning), Chapter 26 (Buildings), Chapter 26A (Underground Utility Districts), Chapter 28A (Mobilehome and Mobilehome Lot Standards), Chapter 28B (State Housing Law Requirements), Chapter 31 (Solid Waste Collection, Management and Recycling), Chapter 32 (Naming of Streets and Highways; Numbering Properties), Chapter 33 (Groundwater Conservation), Chapter 37 (Underground Hazardous Substance Storage Facilities), Chapter 41A (Noise Control), Chapter 50 (Stormwater Ordinance), and the county's post-disaster recovery chapters covering the Camp Fire, North Complex Fire, and Park and Thompson fires. Section 41-3(a) repeats most of that same list to define what each code enforcement officer has a duty to enforce, and gives officers a right of entry onto premises at reasonable times to inspect for violations of those chapters.

Section 41-5 supplies the penalty structure that applies across nearly every chapter on that list: a first conviction draws a $100 fine, a second conviction of the same chapter within twelve months draws $200, and a third or later conviction within that period draws $500. Each day a violation continues is a separate, separately chargeable offense, and three or more convictions of the same chapter in twelve months let the county charge a misdemeanor instead of an infraction. Half of every fine and enforcement fee collected goes to the Development Services enterprise fund and half to the county general fund under Section 41-11.

Violations & Fines

A conviction under any chapter on the Section 41-1 list is an infraction carrying a $100 fine the first time, $200 for a second conviction of the same chapter within twelve months, and $500 for a third or later conviction in that period. Three or more convictions of one chapter within twelve months allow the county to charge a misdemeanor. Unpaid fines become money judgments, and code enforcement officers may record an abstract of judgment with the county recorder.
