Summary

Yakima County Code § 6.20.020 lists the conditions residents most often report to code enforcement: polluted waterways, uncovered garbage, unsanitary animal enclosures within 300 feet of a home, and dead animals left in the open. Any of these is a declared public nuisance.

These county ordinances apply to unincorporated areas of Yakima County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

No stables, barnyards, hogpens, corrals, feedyards, rabbit hutches or other enclosures where domestic animals or poultry are kept and situate within three hundred feet of any building occupied by humans or within three hundred feet of any highway or within three hundred feet of any human residence, shall be allowed to become foul or nauseous or offensive and any accumulation of manure or litter shall be removed daily... Every owner of a dead animal shall cause the carcass of such animal to be interred or otherwise disposed of in a sanitary manner, and no such carcass shall be allowed to remain on or within three hundred feet of a public road, or building inhabited by human beings, more than twelve hours.

Full Breakdown

020 designates a specific list of nuisances forbidden countywide. It bars dumping carcasses, offal, garbage or human or animal excrement into any lake, pond, river, creek, reservoir, irrigation canal or ditch, well, spring or drain, and bars livestock from having access to those waters. Pit privies, cesspools or septic drains cannot sit within 200 feet of any state waters. Stables, barnyards, hogpens, corrals, feedyards and rabbit hutches within 300 feet of an occupied building, a highway, or a human residence cannot be allowed to become foul, nauseous or offensive, and accumulated manure or litter at those sites must be removed daily.

A dead animal cannot be left within 300 feet of a public road or inhabited building for more than 12 hours; the property owner (or tenant, if leased) is responsible for sanitary disposal, and if the owner cannot be found, the road supervisor for that district handles disposal and bills the animal's owner. Dumping garbage or refuse on any public highway or public land is a misdemeanor, as is establishing an unauthorized public or private dump without written permission from the county board of health after a published hearing.

Camping or living in a tent, vehicle or trailer on state, county, railroad or private property outside a recognized, sanitary campground is also listed as a misdemeanor nuisance. Wastewater from a house sink, waste drain or septic tank cannot be discharged into an open ditch or onto a neighbor's property, nor thrown on open ground within 300 feet of an occupied building.

Violations & Fines

Because § 6.20.020 nuisances are enforced as misdemeanors and as abatable public nuisances, the county can pursue criminal prosecution for offenses such as unlawful dumping or unpermitted camping, while the property owner or occupant remains civilly responsible for abating the condition (cleaning up a dead animal, removing manure buildup, or shutting down an unpermitted dump) once notified by the health officer or code enforcement.

Frequently Asked Questions

What counts as a common code violation in unincorporated Yakima County?
YCC § 6.20.020 lists them by name: polluting waterways, keeping foul-smelling animal pens within 300 feet of a home, dumping garbage on public land, running an unpermitted dump, and leaving a dead animal near a road or building for more than 12 hours.
Who is responsible for cleaning up a nuisance on a rental property?
The tenant or occupant is held responsible for abatement if the property is leased, per § 6.20.020(15); the owner is responsible when occupying the property directly.
Is unpermitted camping on private land a nuisance violation?
Yes. Section 6.20.020(7) makes it a misdemeanor to camp, pitch a tent, or park a trailer to live in it on private, state, county or railroad property outside a recognized, sanitary campground.
