Priority 2 cases involve significant code violations that impact the community, such as unpermitted construction in progress, major zoning violations, or conditions likely to worsen. These are investigated within 5 business days. Priority 3 cases are routine violations including property maintenance, minor zoning non-compliance, and aesthetic violations, investigated within 30 business days. The city uses the Accela Citizen Access online portal for code enforcement case tracking. Residents can search for existing code enforcement cases and check status updates. After investigation, a Notice and Order is issued to the property owner with a compliance deadline. If the owner fails to comply, the case may be referred to the City Attorney for legal action.
Non-compliance with Notice and Order can result in administrative citations, civil penalties up to $2,500 per day, and referral to the City Attorney for prosecution. The city may also record a lien against the property.
