Full Breakdown

Section 54-56 opens with findings that juvenile violence, gang activity and crime by those under 17 have increased in the county, and states its purpose as protecting minors, enforcing parental responsibility, and reducing juvenile crime. on Friday and Saturday nights until just after midnight. Subsection (d) creates three offenses: a minor who remains in a public place or on an establishment's premises during curfew hours; a parent or guardian who knowingly permits, or through insufficient control allows, a minor to do so; and an establishment's owner, operator or employee who knowingly allows a minor to remain on the premises during curfew.

Subsection (e) lists nine defenses, including being accompanied by a parent or guardian, running a parent-directed errand without a detour, interstate travel, going to or from employment or a supervised school, religious or recreational activity without a detour, facing an emergency, standing on the sidewalk abutting the minor's own or a non-complaining neighbor's residence, exercising First Amendment rights, and being married or otherwise having disabilities of minority removed; a separate defense protects an establishment operator or employee who promptly notified the sheriff's office that a minor refused to leave.

Subsection (f) requires an officer to ask the person's age and reason for being out, and bars a citation or arrest unless the officer reasonably believes an offense occurred and no defense applies. Subsection (g) makes each day or part of a day of a continuing violation a separate offense.

Violations & Fines

Each day or part of a day a curfew violation continues counts as a separate offense punishable under the Code's general penalty, Section 1-6: up to a $300 fine, up to 90 days' imprisonment, or both. A parent or guardian who knowingly permits or fails to adequately control a minor's curfew violation faces the same penalty, as does a business owner, operator or employee who knowingly lets a minor stay past curfew, unless they promptly notified the sheriff's office and the minor refused to leave.

Frequently Asked Questions

What time does the Bernalillo County juvenile curfew start?
Section 54-56 sets curfew hours at 11:00 p.m. until 6:00 a.m. on Sunday, Monday, Tuesday, Wednesday and Thursday nights, but on Friday and Saturday nights the curfew does not begin until 12:01 a.m., running until 6:00 a.m., so minors may stay out past 11 p.m. those two nights.
Can a minor be cited just for being caught outside at 2 a.m.?
Not automatically. Section 54-56(e) lists nine defenses, including being accompanied by a parent or guardian, on a supervised employment or school/religious/recreational activity without a detour, running an errand at a parent's direction, facing an emergency, or exercising First Amendment rights, and Section 54-56(f) requires the officer to ask the minor's age and reason for being out and confirm no defense applies before citing.
Can parents be punished for a curfew violation?
Yes. Section 54-56(d)(2) makes a parent or guardian guilty of a separate offense if they knowingly permit, or through insufficient control allow, a minor to remain in a public place or establishment during curfew hours, punishable the same as any Code violation under Section 1-6: up to a $300 fine, 90 days in jail, or both.
Is a business liable if a minor is caught inside after curfew?
An owner, operator or employee commits an offense under Section 54-56(d)(3) if they knowingly allow a minor to remain on the premises during curfew hours, but Section 54-56(e)(2) gives them a defense if they promptly notified the sheriff's office that a minor was present and refused to leave.
