Florida's juvenile curfew statute, Fla. Stat. 877.22, bars minors from public places between 11 p.m. and 5 a.m. Sunday through Thursday and between midnight and 6 a.m. on weekends and holidays, with exceptions for a minor with a parent, at work, or in an emergency.
Florida sets juvenile curfew hours by statute under Fla. Stat. 877.20-877.25 rather than leaving them wholly to local option. Section 877.22 prohibits a minor from being in a public place or establishment between 11 p.m. and 5 a.m. Sunday through Thursday and between 12:01 a.m. and 6 a.m. on Saturdays, Sundays, and legal holidays. The law exempts a minor accompanied by a parent or guardian, running a parent's errand, traveling to or from work, or responding to an emergency. The Indian River County Sheriff's Office and Vero Beach and Sebastian police enforce the curfew, and during hurricanes the county can impose a separate emergency curfew on everyone.
The Sheriff's Office and city police enforce the curfew. A first violation typically brings a warning and parental notice, with the minor released to a parent; repeat violations expose the minor and parent to penalties under Fla. Stat. 877.24.
