Allentown's enforceable youth curfew is a daytime, school-hours curfew (Chapter 232): minors may not be in public places roughly 8:00 a.m. to 2:30 p.m. on school days. Allentown's former nighttime juvenile curfew was struck down as unconstitutional in Gaffney v. City of Allentown (1997).
Pennsylvania sets no statewide juvenile curfew; municipalities do. In Allentown the active ordinance is the 'Daytime Curfew' (Chapter 232 of the Codified Ordinances), which bars minors from public places during school hours on days school is in session, unless excused, to promote school attendance. The city's earlier nighttime curfew was invalidated by the federal court in Gaffney v. City of Allentown (E.D. Pa. 1997) for failing strict scrutiny, so no general nighttime youth curfew is currently enforced. Separately, Allentown park rules (Chapter 425) let the Parks Department set hours; many parks and the off-leash dog park operate sunrise to sunset. County parks are governed by Lehigh County, not the city.
On a second or later daytime-curfew offense a minor may be fined up to $600 plus costs; parents may also be fined, and three violations are referred to Lehigh County juvenile authorities.
