Rural Sutter County does not name data centers in its Zoning Code (Title 1500, updated June 28, 2022). Under Table 1500-07-1, the Planning Director classifies a computing or server facility as an industrial use analogous to Research and Development, Communication Services, or Manufacturing, all permitted by right in the M-1 and M-2 districts; unlisted uses may be permitted by the Director under Section 1500-03-030. Industrial standards (Table 1500-07-2) set a 15-foot front setback, a .50 floor-area ratio, and 20-foot (M-1) or 50-foot (M-2) side and rear setbacks next to a Residential District. A utility-scale facility classed as an Intensive Community Facility needs a discretionary Use Permit, triggering CEQA. The code governs unincorporated land only.
Building a data center on land not zoned M-1 or M-2, or without a required Use Permit or CEQA clearance, is a zoning violation. The county can withhold building permits, issue stop-work orders, and require rezoning or permitting first.
