Florida Constitution Article X, Section 24 sets a statewide minimum wage of $14.84 (effective Sept. 30, 2025), rising to $15 in 2026. Tampa cannot set a higher local minimum wage, but the city living-wage policy applies to its own contractors.
The Florida Minimum Wage Amendment (Article X, Section 24, Florida Constitution) sets a single statewide wage floor that adjusts annually. As of September 30, 2025 the rate is $14.84 per hour ($11.81 tipped), and a 2020 voter-approved amendment phases the rate to $15 by September 30, 2026 with annual CPI adjustments thereafter. Florida Statute 218.077 preempts cities like Tampa from enacting higher private-sector wages. Tampa City Council does maintain a Living Wage policy applicable to direct city employees and certain contractors performing services for the City of Tampa.
Below-minimum pay violates federal Fair Labor Standards Act and Florida Constitution standards, exposing employers to back wages, double damages, and attorney fees under FS 448.110, plus enforcement by the Florida Attorney General.
