The California Coastal Act of 1976 (Public Resources Code Section 30000 et seq.) establishes the Coastal Zone in SLO County, generally extending inland 1,000 yards from the mean high tide line and farther in significant resource areas. Title 23 (Coastal Zone Land Use Ordinance) and the certified Local Coastal Program (LCP), including Title 22 Section 22.14.090's LCP Combining Designation, govern development in this area. Most construction, grading, vegetation removal, and changes in use require a Coastal Development Permit (CDP) from SLO County, with appeals available to the California Coastal Commission. Environmentally Sensitive Habitat Areas (ESHA) such as Monterey pine forest, native dune systems, and coastal bluff scrub trigger heightened restrictions. Bluff-top setbacks, public coastal access, view protection, and sea-level rise considerations all apply. Section 23.07.174 protects streams and riparian vegetation.
Unpermitted coastal development is a violation enforced by both SLO County and the Coastal Commission, with fines up to $15,000 per day per violation under PRC 30820-30822. Restoration of the site and significant penalties are common outcomes.
