Under New Jersey's Soil Erosion and Sediment Control Act, N.J.S.A. 4:24-39 et seq., any project disturbing more than 5,000 square feet of surface area in Atlantic County must receive a certified soil erosion and sediment control plan from the DelAtlantic Soil Conservation District before work begins.
The Act requires a certified plan before land is disturbed anywhere in Atlantic County. Projects disturbing more than 5,000 square feet of surface area must submit a soil erosion and sediment control plan to the DelAtlantic Soil Conservation District, formerly the Cape-Atlantic district, and receive certification prior to commencing. Standard measures include silt fence, stabilized construction entrances, sediment basins, and prompt seeding of bare soil. Work on the sandy barrier islands and near tidal wetlands, dunes, the Mullica River, and the Great Egg Harbor River faces added scrutiny, since disturbing a wetland or in the coastal zone can also trigger NJDEP freshwater wetlands, coastal, or CAFRA permits.
Clearing or grading more than 5,000 square feet without a certified plan violates the Act.
