Article VIII of Chapter 7 (Buildings) implements Fort Worth's participation in the National Flood Insurance Program. Within FEMA Special Flood Hazard Areas (SFHAs) and the city's Community Flood Risk Areas (CFRAs), the lowest floor (including basement) of new and substantially improved residential structures must be elevated at or above the Design Flood Elevation (DFE), defined as the base flood elevation (1% annual chance / 100-year) plus 2 feet of freeboard. No development is allowed in a CFRA without an approved CFRA Certificate of Compliance or Stormwater Drainage Study. Nonresidential structures may be elevated or dry-floodproofed to the DFE. The Floodplain Administrator or any code compliance officer is authorized to enforce these provisions.
Building below the Design Flood Elevation is a Class C misdemeanor with fines up to $500 per day. The city may also issue stop-work orders, deny certificates of occupancy, and report violations to FEMA, which can affect community NFIP standing and individual flood insurance rates.
