Summary

Unincorporated Sarasota County requires new construction and substantial improvements in Special Flood Hazard Areas to elevate the lowest floor at least one foot above the Base Flood Elevation, or one foot above the Florida Building Code minimum or the 100-year 24-hour flood stage, whichever is higher. The County Floodplain Administrator enforces this freeboard rule under the Flood Damage Prevention Ordinance.

Full Breakdown

0 foot, the elevation required by the Florida Building Code, or one foot above the 100-year 24-hour maximum flood stage, whichever is higher. Where a parcel spans two flood zones, the whole structure must meet the more stringent zone's requirement (§ 54-516(a)(2)). In A Zones lacking published Base Flood Elevation data, builders must instead use the elevation the Floodplain Administrator determines under § 54-519(1). 0 foot, and enclosures below that level must be built with breakaway walls. Enclosed space below the minimum elevation is limited to parking, building access or storage, and must carry flood openings sized to at least one square inch of net area per square foot of enclosed floor (§ 54-516(a)(8)).

Any development in an adopted Flood Hazard Area needs a permit under § 54-517 before the Floodplain Administrator will confirm compliance. The Building Code Board of Adjustments and Appeals can grant variances to build below the required elevation, but a granted variance must be recorded in the county's public land records and expires 180 days after issuance unless a building permit is pulled within that window (§ 54-518).

Violations & Fines

A violation of the Flood Damage Prevention Ordinance is enforced as a misdemeanor under F.S. § 125.69, punishable by a fine of up to $500.00, imprisonment up to 60 days, or both, with each day the violation continues charged as a separate offense (§ 54-520(a)). Obstructing a code enforcement officer investigating a flood-construction violation is a separate offense under the same section.

Frequently Asked Questions

How high above Base Flood Elevation must a new home be built in unincorporated Sarasota County?
At least one foot higher, under Sarasota County Code § 54-516(a)(1). The lowest floor must sit at or above the Base Flood Elevation plus 1.0 foot, the Florida Building Code's required elevation, or one foot above the 100-year 24-hour flood stage, whichever of the three is highest for the site.
What elevation applies if my Sarasota County lot is in an A Zone with no published Base Flood Elevation?
Section 54-516(a)(4) requires the lowest floor to sit at least one foot above a Base Flood Elevation that the Floodplain Administrator determines under § 54-519(1), since FEMA has not mapped a specific elevation for that A Zone.
Can Sarasota County grant a variance to build below the required flood elevation?
Yes. The Building Code Board of Adjustments and Appeals may grant a variance under § 54-518, but it must be recorded in the county's public land records at the applicant's expense and expires within 180 days unless a building permit is issued in that period.
