Title. These regulations shall be known as the Floodplain Management Ordinance of Okaloosa County, hereinafter referred to as "this section." Scope. The provisions of this section shall apply to all development that is wholly within or partially within any flood hazard area, including, but not limited to, the subdivision of land; filling, grading, and other site improvements and utility installations; construction, alteration, remodeling, enlargement, improvement, replacement, repair, relocation or demolition of buildings, structures, and facilities...placement, installation, or replacement of manufactured homes...installation of swimming pools; and any other development... This section shall apply to all flood hazard areas within the unincorporated area of Okaloosa County, as established in Section 3.06.02.C...Any owner or owner's authorized agent ("applicant") who intends to undertake any development activity within the scope of this section...shall first make application to the Floodplain Administrator...and shall obtain the required permit(s) and approval(s).

The County Engineer is designated Floodplain Administrator and must approve a development permit before any covered activity proceeds, coordinating with the Building Official where the Florida Building Code also applies. The ordinance supersedes any earlier flood-management ordinance but does not repeal zoning, stormwater, or Building Code requirements, and the more restrictive rule controls if they conflict. Because larger floods than the mapped base flood can and do occur, the ordinance expressly disclaims that compliance guarantees a property will stay dry, and it shields the Board of County Commissioners and its officers from liability for flood damage that follows compliant development.
Violations & Fines
Any development regulated by section 3.06.00 that proceeds without an issued permit, conflicts with an issued permit, or otherwise fails to comply is a violation under section 3.06.09. A building lacking the required elevation certification or other compliance documentation is presumed to be in violation until the owner produces it. Enforcement follows the administrative and enforcement procedures in Article VI of Chapter 11 of the Code of Ordinances.
