Sec. 16.3.1 - Lands to which this ordinance applies. This ordinance shall apply to all Special Flood Hazard Areas within the jurisdiction of Gaston County, including Extra-Territorial Jurisdictions (ETJs) where the municipality is not providing Flood Damage Prevention regulations or administration and within the jurisdiction of any other community within Gaston County, whose governing body agrees by resolution, to such applicability. Sec. 16.3.3 - Establishment of floodplain development permit. A Floodplain Development Permit shall be required in conformance with the provisions of this chapter prior to the commencement of any development activities within Special Flood Hazard Areas determined in accordance with the provisions of Section 16.3.2 of this chapter. Sec. 16.3.8 - Penalties for violation. Violation of the provisions of this chapter or failure to comply with any of its requirements...shall constitute a misdemeanor. Any person who violates this chapter or fails to comply with any of its requirements shall, upon conviction thereof, be fined not more than $50.00 or imprisoned for not more than 30 days, or both. Each day such violation continues shall be considered a separate offense.
