Section 54-516(a)(1) sets the baseline elevation rule for Zones A, A1-A30, AE, AO, AH, and Community Flood Hazard Areas: the lowest floor of new construction or a substantial improvement must clear the Base Flood Elevation plus one foot, the Florida Building Code elevation, or one foot above the local 100-year, 24-hour flood stage, whichever is higher.

Floodways get stricter treatment: Section 54-515 bars new fill, encroachments, and substantial improvements there unless a licensed engineer certifies the work won't raise flood levels or push water onto neighboring land. Violating the elevation, floodway, or coastal construction standards is prosecuted the way misdemeanors are prosecuted under F.S. Section 125.69, punishable by a fine up to $500.00, up to 60 days in the county jail, or both, with each day of noncompliance a separate offense. Obstructing a code enforcement officer carries the identical penalty. The County can also pursue injunctive relief or route enforcement through Chapter 162, Florida Statutes, and Chapter 2, Article VIII of the county code, under Section 54-520.
