Lee County Land Development Code § 6-401 reaches every development wholly or partly inside a flood hazard area: subdividing land, filling and grading, altering buildings and structures exempt from the Florida Building Code, placing or replacing manufactured homes, installing tanks, parking recreational vehicles, and building swimming pools. Before touching a flood hazard parcel, an owner must file for a floodplain development permit with the Floodplain Administrator under § 6-433, and no permit issues until the applicant satisfies this article and every other applicable code. Depending on what's proposed, the Floodplain Administrator can require a floodplain development permit in addition to a building permit under § 6-434. Violations & Fines
Building in a flood hazard area without documented lowest-floor elevation or other proof of compliance is presumed a violation under § 6-471 until the owner produces it. The Floodplain Administrator can issue a notice of violation or a stop-work order under § 6-472, and continuing work after that notice is served is a separate offense under § 6-473. The Land Development Code's general penalty, § 1-5(c), sets a fine up to $500 and up to 60 days in jail, with each continuing day a separate offense.
