(a)Permits required. Any owner or owner's authorized agent (hereinafter "applicant") who intends to undertake any development activity within the scope of this article, including buildings, structures and facilities exempt from the Florida Building Code, which is wholly within or partially within any flood hazard area or in close proximity to flood hazard areas, shall first make application to the floodplain administrator, and the building official if applicable, and shall obtain the required permit(s) and approval(s). No such permit or approval shall be issued until compliance with the requirements of this article and all other applicable codes and regulations has been satisfied.

Sec. 101 covers activity wholly or partially within a flood hazard area or in close proximity to one, including subdivision of land, filling, grading, utility work, construction or alteration of buildings and structures exempt from the Florida Building Code, manufactured home placement, tank installation, recreational vehicle placement and swimming pool installation. Sec. 105(a) requires the owner or an authorized agent to apply to the floodplain administrator, and the building official where applicable, before starting any covered activity, and bars issuance of a permit until the applicant demonstrates compliance with the article and all other applicable codes.
Sec. 105(c) separately requires a development order for buildings and facilities exempt from the Florida Building Code, such as railroads, farm buildings, temporary construction sheds and utility structures, so exempt structures in a flood hazard area still go through county review. Applications must include a site plan or construction documents under Sec. 106, and new construction generally needs a flood letter certification, sealed by a Florida-licensed engineer, establishing the base flood elevation and flood protection elevation for the parcel; certifications older than five years are not accepted.
Where a structure or vehicular use area sits within a flood hazard area, Sec. 105(f) requires the applicant to record a waiver releasing the county from future flood damage claims, extending to any parcel within 20 feet of a flood hazard area shown by GIS contour data. The floodplain administrator can suspend or revoke a permit issued in error or on incomplete information.
Violations & Fines
Sec. 10-8.109 makes any development in the article's scope that proceeds without a permit, conflicts with an issued permit, or fails to fully comply, a violation; a building lacking required lowest-floor elevation certification is presumed noncompliant until the owner produces it. The floodplain administrator can issue a notice of violation or a stop work order, and continuing work after that notice is a separate offense subject to penalties as prescribed by law.
