Frequently Asked Questions

What does Monterey County's stormwater ordinance prohibit?
Section 16.14.100 makes it unlawful to discharge, directly or indirectly, any non-stormwater into the County storm drain system, or to discharge material into stormwater that would violate the State's general stormwater permit. Exceptions cover things like NPDES-permitted discharges, water line flushing, landscape irrigation and uncontaminated ground water, which are not treated as prohibited discharges under Section 16.14.100(B).
Does Monterey County's stormwater chapter apply outside the unincorporated area?
No. Section 16.14.050 limits the chapter to dischargers located within the unincorporated urbanized areas of the county that discharge into the county storm drain system; agricultural discharges are excluded entirely, and cities such as Salinas, Monterey and Seaside enforce their own separate stormwater programs.
What stormwater controls apply to construction sites in unincorporated Monterey County?
Section 16.14.140(C) requires anyone with a building or grading permit to implement best management practices controlling pollutant discharge to the maximum extent practicable, comply with the State construction general permit, and eliminate any non-stormwater discharge not covered by a valid NPDES permit for the duration of construction.
