Brevard County stormwater management is governed by Code Chapter 62 and the St. Johns River Water Management District (SJRWMD) Environmental Resource Permit (ERP) program. New development and major renovations must include stormwater management plans with retention/detention to treat the first inch of rainfall. Impervious surface limits apply (see lot-coverage). Low-impact development (LID) techniques encouraged: rain gardens, permeable pavers, bioswales, cisterns. Indian River Lagoon basin properties face enhanced nutrient load reduction requirements under the Save Our Lagoon half-cent sales tax program. Brevard's fertilizer ordinance (Code Ch. 62) bans nitrogen and phosphorus fertilizer application June 1-September 30 (rainy season) to protect lagoon water quality. Erosion/sediment controls required during construction.
Failure to implement stormwater plan: stop-work order. Illicit discharge to storm drains/lagoon: $500-$10,000 per day. Fertilizer blackout violation: $500 first offense, up to $5,000 repeat. MS4 permit violations: additional FDEP penalties.
