Caldwell City Code 10-02-07 requires fences to conform to height, setback, and material standards in every zoning district except C-C City Center. Street-frontage fences built after December 1, 2019 must show the finished side outward, and fences cannot obstruct a vision triangle.
Under Caldwell's Fencing Regulations (Section 10-02-07), no fence may be constructed or installed in any zoning district, except the C-C City Center district which has separate rules, without conforming to the city standards. The regulation reaches fence posts, gates, and all fencing materials, and covers height, setback, and material. Key general requirements include: open and solid fencing along interior side and rear lines is capped at six feet, with reductions near the front property line and within vision triangles (maximum three feet). Any fence with street frontage installed after December 1, 2019, must be installed so the finished or "good" side faces the exterior of the property. Fences that are nonconforming but were in place before the standards were adopted may remain if kept in good condition and repair and if they do not impede motorist safety or create a hazard. A property owner who wants to build a fence that would not comply may apply for a variance through the city's land-use process. Because Caldwell rewrote much of Chapter 10 in 2025, the precise subsection numbering may have shifted; verify current language with the Planning and Zoning Division and confirm whether a building permit (for walls over four feet or masonry construction) or only zoning compliance applies to your project.
Noncompliant fences are enforced by the Code Compliance Division, which can order correction or removal. Penalties for zoning violations can reach $300 per day and/or 30 days imprisonment for each day the violation continues.
