Quiet hours in Caldwell, ID — also called the noise ordinance, nighttime noise rules, or residential quiet time — define the hours during which excessive noise is prohibited.
Caldwell sets citywide quiet hours from 11:00 p.m. to 7:00 a.m. under City Code Section 07-13-03. During those hours it is unlawful to make or allow loud or offensive noise, by any means, that disturbs the peace, quiet, and comfort of a reasonable person. 'Loud or offensive noise' is sound plainly audible 150 feet or more from its source.
Caldwell City Code Title 7, Article 13 (Public Noise Disturbance), Section 07-13-03 provides that between the hours of eleven o'clock (11:00) P.M. one day and seven o'clock (7:00) A.M. the next day, it shall be unlawful for any person or business to make, cause, or allow loud or offensive noise by means of voice, musical instrument, horn, radio, loudspeaker, automobile, machinery, other sound amplifying equipment, or any other means which disturbs the peace, quiet, and comfort of any reasonable person of normal sensitiveness residing in the area. The ordinance does not use a decibel meter; instead it defines 'loud or offensive noise' as sound that is plainly audible within any place of residence, business, hospital, farm property with animals, or restaurant (other than the source) at a distance of one hundred fifty feet (150') or more from the source. Section 07-13-05 lists exceptions, and a separate downtown/event-area provision lets city-sponsored events at Caldwell Memorial Park, the downtown core, and the Caldwell Event Center / Entertainment Center areas run loud noise past 11:00 p.m. until 1:00 a.m. on Fridays and/or Saturdays only. Outside the 11:00 p.m.–7:00 a.m. window, unreasonable noise can still be cited as disorderly conduct under Section 08-01-27.
Making or allowing loud or offensive noise (plainly audible at 150 feet) between 11:00 p.m. and 7:00 a.m. violates Section 07-13-03. The City's nuisance abatement provisions (Section 07-11-05) let peace officers and code enforcement officers issue citations; if a noticed nuisance continues, the offense is a misdemeanor, and each day a violation continues may be treated as a separate offense. Unreasonable noise at any hour may instead be charged as disorderly conduct (Section 08-01-27), a misdemeanor penalized up to the limits in Idaho Code 50-302.
