Caldwell, ID Fire Regulations: Fireworks (2026)

The Caldwell Fireworks Ordinance sits inside section 08-13-09 as Amendment One to the International Fire Code. It defines dangerous fireworks as anything that launches into the air and/or explodes, including firecrackers, bottle rockets, cherry bombs, M-80s, roman candles, sky rockets, and mortar-fired shells, and bans discharging them at any time in the city. Non-aerial common fireworks, the 'safe and sane' category such as ground spinners, fountains, sparklers, smoke devices and snakes that stay within a 15-foot circle and do not land sparks outside 20 feet or above 20 feet, may be sold at retail only under a non-aerial common fireworks permit issued by the city clerk.

Each application requires operator identification, an Idaho sales tax seller's permit number if applicable, a to-scale site plan, an application fee under the city's fee schedule, and a certificate of public liability and property-casualty insurance. The clerk must deny an application if the applicant was convicted of fraud, larceny, arson, or illegal fireworks sale within ten years, or of a city zoning, building, fire or health code violation within one year, and denials can be appealed to the City Council.

Temporary fireworks stands are capped at 600 square feet, must sit at least 25 feet from any building or generator and 100 feet from any flammable liquid dispenser, and must post 'NO FIREWORKS TO BE DISCHARGED WITHIN 300 FEET' signs in English and Spanish. Anyone under 16 is barred from purchasing, possessing, or discharging non-common aerial fireworks without a parent or guardian present, and that parent or guardian is liable for any damage the minor causes, including fire suppression costs.
