The City of Caldwell enforces the Idaho Fireworks Act of 1997, codified at Idaho Code 39-2601 through 39-2614, with the Caldwell Fire Department acting as the 'authority having jurisdiction.' Under Idaho Code 39-2602(6), the only fireworks the public may possess and use are 'nonaerial common fireworks' such as ground spinners, fountains, sparklers, smoke devices and snakes that stay within a fifteen-foot diameter circle and do not throw sparks beyond a twenty-foot circle or above twenty feet. Firecrackers, jumping jacks and any aerial device are not nonaerial common fireworks and are illegal for personal use. Idaho Code 39-2606 limits legal sale and use to two windows: midnight June 23 through midnight July 5, and midnight December 26 through January 1. Aerial and 'special' fireworks may only be discharged under a public-display permit issued by the authority having jurisdiction per Idaho Code 39-2605, after a determination that a qualified operator will supervise. Caldwell's city code further requires a permit from the city clerk before any public display or sale of fireworks within the city.
Selling or using fireworks outside authorized dates, or altering fireworks, is an infraction punishable by a $100 fine under Idaho Code 39-2609. Other violations of the chapter are misdemeanors under Idaho Code 39-2613, and fireworks used unlawfully may be confiscated. Parents are liable for damage caused by a minor's fireworks (Idaho Code 39-2611).
