Little Elm Ch. 106 Div. 6 sets fence standards: permits required, 3-ft masonry setback from property lines, maintenance obligations enforced. HOAs often add material and style rules.
Little Elm Code Chapter 106 Zoning Article VI Division 6 establishes comprehensive fence standards for residential and commercial properties. A building permit is required for all fence construction through the Building Safety Division. Fences must be set back a minimum of 3 feet from property lines for masonry or substantial wall construction per the Accessory Structures Guide (March 2024). Standard wood privacy fences may be placed on or near the property line but property owners are responsible for confirming the accurate boundary through a current survey. All fences must be maintained in good structural condition without leaning, broken boards, or missing sections. The town enforces maintenance standards through Code Enforcement. Fences in the public right-of-way or utility easements may be required to be removed or relocated at the owners expense if utility access is needed. Corner lot fences must maintain sight visibility triangles at intersections. Swimming pool barriers have separate requirements under the 2018 IRC. HOAs in Little Elms master-planned communities frequently specify fence materials, colors, and styles beyond minimum code requirements.
Unpermitted fence: code enforcement notice, potential removal order. Poorly maintained fence: notice to repair with deadline. Fine up to $500 per violation.
