San Clemente requires fences, walls and hedges to be maintained so they are not a traffic, person or property hazard, measures height from the lower side of finished grade, and keeps front-yard structures low for an open street scene.
SCMC Section 17.24.090 requires that fences, walls and hedges in all zones be maintained so they do not constitute a hazard to traffic, persons or property. Height is measured from the lower side of finished grade to the top of the fence, and includes all structural supporting elements such as pilasters and trellises. The stricter front-yard limit of 3 feet 6 inches keeps an open street scene and preserves views of traffic to and from driveways. Separately, SCMC Section 17.32.050 limits most structures in the residential front-yard setback to 42 inches; arbors may exceed this up to 7.5 feet only with a Minor Exception Permit per Table 17.32.050B. Nonresidential fence height and materials are set through architectural review.
A fence that is unsafe, poorly maintained, or built taller than allowed for its lot area violates SCMC 17.24.090. Structures other than approved arbors that exceed 42 inches in the front-yard setback violate SCMC 17.32.050. Code Enforcement: 949-366-4705.
