Unincorporated Jefferson County does not require a fence permit, but the Zoning Resolution caps fence height in Residential Districts at 6 feet (Section 30.F.1). Within the front-setback line and front lot line, no fence of any type may exceed 42 inches (Section 30.F.2). Barbed-wire and electric fences are prohibited in residential zone districts (Section 30.F.3). Where adjacent lots have different allowed heights, the lower restriction governs (Section 30.F.4). Corner lots must comply with the vision clearance triangle. Mountain Residential and Agricultural districts have separate caps. Contact Planning & Zoning at 303-271-8700.
Jefferson County's fence rules sit in the Zoning Resolution, not the building code. Section 30 (Residential District, last amended 5-10-22) sets a 6-foot maximum fence height across all R-1, RR, R-1A through R-4 zone districts; no fence over 42 inches is allowed within the front setback line, and barbed-wire or electric fences are not permitted. On adjacent lots with differing allowed heights, the lower height controls. Section 31 (Mountain Residential) also caps fences at 6 feet but limits front-setback fences to 42 inches. Section 33 (Agricultural) allows up to 7 feet, with fences over 42 inches permitted within the front setback. Corner-lot fences must comply with the vision clearance triangle in Section 02 (General Provisions) to preserve traffic sight distance. Per the county's Outside the Home guidance, fences in unincorporated Jefferson County no longer require a building permit, though gates require a Miscellaneous Permit. Setbacks for fences are governed by the underlying zone district's setback table in Section 30.E. All fences must be maintained in good repair under property maintenance rules. Cities within Jefferson County (Lakewood, Arvada, Wheat Ridge, Golden, Westminster, Edgewater, Morrison) operate their own fence codes inside city limits and typically do require permits.
Fences exceeding the Zoning Resolution height caps, placed in a vision triangle, or built with prohibited materials (barbed wire, electric) in a residential zone district can be cited by Planning & Zoning code enforcement. Owners receive a notice of violation and must either remove or modify the fence; continued non-compliance may result in summons to county court and civil penalties. Property-maintenance violations (broken-down or hazardous fences) are pursued under Section 02 General Provisions.
