In unincorporated Polk County, opaque fences are limited to eight feet measured from the ground unless a building permit is obtained through a Level 1 Review. Taller fences need that permit; corner-lot fences must also stay out of the clear visibility triangle.
Polk County Land Development Code Section 210 governs fences in unincorporated areas. Opaque fences are capped at eight feet from grade; anything taller requires a building permit via a Level 1 Review. Fences cannot sit in the right-of-way, impede drainage, or block emergency access. On corner lots no fence may fall inside the Section 711 clear visibility triangle, which keeps sightlines clear between three and eleven feet above grade. Incorporated cities such as Lakeland, Winter Haven, and Bartow set their own fence heights.
Enforced by Polk County Code Enforcement; unpermitted or non-conforming fences can draw code-enforcement citations and daily fines/liens under Florida Statutes Chapter 162.
