Summary
Sumner County bans barbed wire, razor wire, and electrified fencing on residential property, along with flammable fencing like cloth or canvas, solid plywood or scrap-lumber fences, and unfinished cinderblock or concrete block walls. Agricultural livestock enclosures and government-erected security fencing are the main exceptions to the barbed-wire and electric-current bans.
4. Prohibited Fences. The following types of fences are prohibited:
a. Fences constructed primarily or topped with barbed wire or razor wire, or deployed, raised, arranged or expanded in concertina form, except when used in conjunction with an agricultural use or purpose, non-residentially zoned property or uses, and/or serving a public institution for public safety or special services.
b. Fences carrying electrical current, except for the purpose of enclosing livestock for an agricultural use
c. Fences constructed of readily flammable materials such as paper, cloth or canvas except for temporary fences required by law (e.g. drainage silt fencing)
d. Fences or walls made of solid plywood, scrap lumber and insubstantial similar non-customary materials
e. Fences or walls made of common concrete or cinderblock, unless finished with a masonry material.
f. Fences, wall or hedges on any portion of any public right-of-way, except those erected by a governmental agency
Full Breakdown
Section 1101, Subsection B(4) of the Zoning Resolution lists six categories of prohibited fencing that apply across the unincorporated county. Barbed wire, razor wire, and concertina wire are barred outright, with a narrow carve-out for agricultural use, non-residentially zoned property, or fencing serving a public institution's safety or special services. Fences carrying electrical current are likewise prohibited except when used to enclose livestock for an agricultural purpose, so an electric pet-containment fence around a suburban yard does not qualify for that exception. Readily flammable fencing materials such as paper, cloth, or canvas are banned, though the Resolution carves out temporary fencing required by law, such as construction-site silt fencing for erosion control.
Solid plywood, scrap lumber, and other insubstantial, non-customary materials cannot be used for a permanent fence or wall, and common concrete block or cinderblock walls are prohibited unless finished with a masonry material such as stucco or stone veneer, so a bare cinderblock wall fails inspection even if it meets height limits. A final material rule bars any fence, wall, or hedge from standing on public right-of-way, except one erected by a government agency. Combined, Subsection B(4) is a materials-based screen that operates independently of the height limits in Subsection B(1): a fence can meet the 8-foot cap and still be rejected if it is built from a prohibited material.
Violations & Fines
Building or maintaining a fence from a prohibited material violates Section 1101 of the Zoning Resolution. The Director of Building Codes can order the fence repaired, replaced, or removed under Subsection B(8), and continued noncompliance is a misdemeanor under Section 1413, Subsection D, punishable by a fine plus court costs, with each day of violation charged as a separate offense.
