Ohio's partition (line) fence law, ORC Ch. 971, governs shared boundary fences mainly where livestock is kept. It does not apply to lots inside cities or platted subdivisions. Neighbors can agree in writing to divide fence duties.
Butler County itself sets no neighbor-fence cost-sharing rule. Ohio's line-fence statute (ORC Ch. 971) requires a 'preferred partition fence' along the division line where livestock is kept (971.02). Importantly, 971.03 excludes lots inside municipal corporations and platted subdivisions outside them, so most suburban Butler County fences fall outside the statute. Adjoining owners may sign a written agreement changing their fence duties, filed with the county recorder to run with the land (971.04). Disputes over rural partition fences go to the township trustees.
Not criminal. Remedy is civil: township trustees can assign or apportion partition-fence costs, and a recorded 971.04 agreement binds later owners.
