Nebraska's division-fence law, Neb. Rev. Stat. sections 34-101 to 34-112, sets Sarpy County apart from most states. Where a fence divides two adjoining tracts, each owner must build and maintain a "just proportion" of it, which the statute treats as an equal share unless the neighbors agree otherwise. The law does not force a fence where neither owner wants one, and city zoning, not this statute, governs heights in a Papillion or La Vista subdivision. If a neighbor refuses to keep up their portion on rural or acreage land, section 34-103 requires seven days' written notice before you can sue. Nebraska is both a fence-in and fence-out state for livestock.
On qualifying adjoining land, an owner who won't pay a fair share of a division fence can be taken to court after the required written notice. In a platted subdivision, a boundary-fence dispute is a civil matter between neighbors.
